Trump is now invoking executive privilege to prevent Rep. Joyce Beatty's lawyers from obtaining documents and testimony about his involvement in the Kennedy Center's management and closure.
Here's the problem: Trump is chairman of the Kennedy Center's Board of Trustees, but that's a position separate from his responsibilities as President of the United States.
The Justice Department argues that because the President appoints Kennedy Center trustees, communications about managing the institution can fall under presidential communications privilege - even some conversations that don't involve Trump directly.
Beatty's lawyers are trying to determine whether the Board made an independent, informed decision to close the building. The government is fighting to keep certain communications out of their hands.
Judge Cooper hasn't ruled on the privilege dispute yet.
Meanwhile, six beautiful theaters remain dark, and JFK's name remains shrouded in that silly tarp.
