So I'm one of the folk subject to being locked out of their account by whatever "bot" flagging algorithm they have going on. That's one thing. But today, I got an email offering their X credit card. I attempted to unsubscribe from the email, but unsurprisingly, X/Twitter requires you to log in to unsubscribe. But I can't log in because of the account lockout and fixing the lockout requires a broken system to work properly. As I'm sure many folk here are aware.

In any case, this is interesting because this combination of factors looks like a violation of the CAN-SPAM Act, which requires commercial emails to provide a functional unsubscribe option (and the legal reason why commercial emails all have Unsubscribe buttons-companies don't put them there because they want to be nice). X/Twitter sent me a commercial email, and I can't unsubscribe.

That being said, and by way of disclaimer, I don't expect reporting these violations to necessarily do anything, especially in the short term. I don't know that what happened to me or anything that happened to you is a violation, and I'm not telling you to do anything. Just saying it looks like one from my nonexpert position.

But it is useful for any future investigation to create documentation of potential legal violations by X/Twitter. I know folk are frustrated by the inability to do anything about account lockouts and whatnot. And I certainly don't mind creating a headache somewhere down the line for the company.

For added context and cuz it's interesting, from the FTC's page on complying with CAN-SPAM:

"Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your message. You must honor a recipient’s opt-out request within 10 business days. You can’t charge a fee, require the recipient to give you any personally identifying information beyond an email address, or make the recipient take any step other than sending a reply email or visiting a single page on an Internet website as a condition for honoring an opt-out request. Once people have told you they don’t want to receive more messages from you, you can’t sell or transfer their email addresses, even in the form of a mailing list." Apparently, fines can go up to $53,088 per violating email. That'd be funny.

I have a medication I take daily, while taking it I’ve had to increase the daily dose. At one point I just switched to 36mg and was given a 90 day supply by the specialty pharmacy. During the first month the doctor increased the dose again leaving me with 2 unopened bottles. There are several charities that accept unopened bottles of medication and get it to people that really need it. Considering that the cheapest you can find one bottle for is 12k on good Rx, I’m sure these would help someone significantly. When I tried to donate I was told it is illegal to donate medications that were paid for by Medicare (I’m disabled). So instead of helping to improve someone’s life, my only option is to trash tens of thousands of dollars.
