Legal āļø Legal advice, trouble collecting deceased personās pistol
Hi folks,
A friend of mine recently passed and his wife was not allowed to get his daily carry pistol back because local PD (paraphrasing) āis having a hard time proving heās the ownerā.
All the info I have so far is second hand, as my wife is the one spending more time with the widow.
Context:
The widow is our very good friend and we are trying to take as much off her plate as we can.
My friend passed from a medical reason.
The widow is certain his daily carry pistol is registered to her husband.
There are more guns safely stored in their home.
I understand the sensitivity of handing her the pistol to take home as part of his belongings. My goal is to prevent her from having to hire an attorney to handle this issue or it get more difficult as time passes.
My questions are, do any of you have experience with a situation like this and can offer some guidance? Is it standard to hold the firearm for a certain amount of time for safety reasons? Will this become a time sensitive issue that will be harder for her to button up the longer she waits?
I appreciate all the help I can get.
