Legal Question ⚖️ Am I the only one…
I will open this post with an admission. I normally find myself viewing the glass half empty which is actually something that, when I realize, I try to remedy/reverse. So in asking this question, I’m leaning on some of you to show me that beautiful half full glass I sometimes overlook.
A federal judge in Texas held that provisions could no longer be justified under Congress’s taxing power for the $0-tax items. The judge also rejected the government’s alternative interstate-commerce justification. In plain English, the reasoning was: you cannot keep enforcing this tax-administration system when its underlying tax raises no money. That is this court’s ruling, rather than a universal rule that every zero-dollar tax invalidates related regulations.
So couldn’t this work both ways? If Congress restored a tax—even a small amount—the government would have a stronger argument that registration again serves a revenue-collecting purpose. That could undermine the basis of the current ruling. The ATF specifically identifies a new tax as something that could cause enforcement to resume. And in this same vein, the original tax was originally intended to be cost prohibitive to the average citizen. Because this tax was never adjusted for inflation, it had become relatively manageable for most of us on a few purchases throughout the year. What is the likelihood that an oppressive future administration not only reinstating that tax but to a cost prohibitive number for us regular folk?
For someone who bought a suppressor using only a 4473, or created an SBR, the concern is continued possession of an unregistered item after enforcement resumes. ATF says there is no automatic grandfather protection and generally no ordinary way to register an already-unregistered NFA item afterward. An amnesty or new legislation could provide a registration window, but neither is guaranteed.
I’ve heard the common use argument but how likely is this to be successful? We haven’t even been able to get a ruling on the common use of AR’s from the Supreme Court! And for those that say just don’t register and non-compliance is the only way, that’s not an option for me for a variety of reasons including being the breadwinner in a home with two young children.
I just reviewed this rant and I don’t mean to come off ungrateful for these changes or opportunity. I’m just nervous about skipping this whole $0 tax and then registration becomes necessary again at an astronomically higher tax. I’m also hesitant bc this is my first Reddit post and I’ve seen people get shredded for speaking about things the majority sees as “disagreeable”. Again, sorry for the rant but I’m very interested to hear everyone’s thoughts on this issue and hopefully hear some more positivity from the group.
