Mod Announcement Introducing Verified Flairs for Advocates & Senior Counsel: Verification Guidelines & Disclaimers

Hello everyone,

As r/indialaw grows, we want to make sure members reading legal discussions have clear context on who is participating. At the same time, we need to uphold ethics under the Advocates Act, 1961 and maintain high standards of privacy and credibility.

To achieve this, we are officially launching restricted, moderator-assigned user flairs:

  • Advocate (Verified)
  • Senior Advocate / Counsel

Community members, law students, and in-house professionals can continue to self-assign their respective open flairs. The Verified badges, however, will be reserved strictly for enrolled practitioners following a private review.

How to Claim Your Verification Flair

If you are an enrolled advocate practicing before courts or tribunals in India and wish to receive this flair, send a message to Modmail with the following:

  1. Subject Line: Verification Request: Advocate / Senior Counsel
  2. Proof of Enrollment: A clear photo or scan of your State Bar Council ID card or Certificate of Enrollment.
  3. Identity Match: A piece of paper placed next to the ID displaying your Reddit username (u/yourusername) and today's date handwritten.
  4. Privacy Protection (Crucial): Feel free to redact sensitive non-public personal details (e.g., your residential address, personal phone number, or Aadhaar number). Your full name, photograph, and Bar Council Enrollment Number must remain visible so we can verify your standing on the public State Bar directory.

All submissions sent via Modmail are reviewed solely by the moderation team and are permanently deleted or discarded once verified. We will never share your personal identity or credentials publicly.

Important Notes & BCI Compliance

  1. No Solicitation or Advertising: Verification is purely an indicator of professional background for informational credibility. It is not a license to solicit clients, post contact information, quote legal fees, or divert cases into DMs. Rule 4 (BCI Solicitation Norms) and Rule 5 (No External Links) will be enforced equally across all members, verified or not.
  2. Statutory Disclaimer: Verified status does not create an advocate-client relationship with any user on this forum. Comments made by verified members remain purely educational, academic, and informational opinions.
  3. Revocation: Any verified user found dispensing unethical advice, soliciting offline clients, or violating community safety policies will have their verification revoked immediately and face moderation action.

Thank you for contributing your time and expertise to make r/indialaw a grounded, legally sound community. If you have any questions or feedback regarding the process, drop them in the comments below!

Criminal & Police Brother was threatened with arrest and fines for intoxication

Background - Me and my brother are visiting mutual friends for an engagement party in a non-native city. We are currently staying in a hotel and will be leaving tomorrow (i.e Monday or 19/10/2026)

Incident - We were invited to a get together at our mutual friends house for a night of video games + food + alcohol (we are all above the age of 23) We arrived around 7pm and stayed playing FIFA, 2K and stuff till around 12am whilst drinking and eating food we ordered. There were only 4 of us the entire time and we did not have any loud music playing, or did anything that would otherwise be constituted as noise or disturbance. The flat as well is owned by my friend and not rented.

Around like 11pm the building security came over and knocked on the door, my friend (the owner) answered and he told us that the unit above and below was complaining that we were being too loud and making a lot of noise. He told us we cant have parties like that. My friend showed him that we are not having any parties and its just 4 people. The guard mumbled something in telugu and left.

Around 11:45ish we all decided to head our seperate ways and go home. One of our friends drove in his car and decided he would spend the night there and me and my brother decided to book an uber home. All four of us walked down to basically wait for the cab when a police car pulled up and told us they recieved multiple calls about "harassment, intoxication and illegal substances"

When we tried reasoning with them they basically hounded us for lying and being drunk in public. We tried to explain that two of us (me and my brother) are leaving the apartment and going home and the other two (one lives there and ones staying over) but they didn't believe us. He asked us if we drank and we said yes, cause we had been. They then started raising their voices at us telling us that we could be arrested and everything. The police then diverted their attention toward me and my brother (who are not native to this city or state) and asked where we were from. We told them we dont speak telugu and he started getting more aggressive with us talking about how we are ruining his city and state.

They only left after my friends dad came down and spoke to them, before leaving they took down our information and said they'd come visit us before we left to "further investigate"

None of this seems legal and/or right, what can we do to protect ourselves from this harassment and how can we move forward ? do we contact authorities or do we just wait and see what happens and leave ?

So we bought a house from the person who had got house from government. suchit ....idk. We bought this around 15 years ago. So now that person from who we bought isn't alive no more but their sons now looking for their clams in this house. Today the 2 GRD police came to our house and told us to come to the police station with the property papers. They didn't show us any FIR or complaint paper. So what we should do. Should we show the paper to the police officer without FIR or complaint. Does police have authority to check our property police paper. What we should do

Employment & Labour Employer threatening to sue for quitting in day one

Sorry for long post.

I applied for this new job in September, as an English teacher in a coaching center. They hired me on the spot and told me to start from the next day. I politely told them that I needed to give my current job one month notice period as that was industry practice. After some discussion, they agreed and I signed an offer letter.

So the offer letter said the job offer was provisional for first three months, and they would extend in depending on my performance in these three months. It also said that after the provisional period, I would have to work for two years. And the notice period was one month, again, after the provisional period. There was no mention of notice period during the provisional period. So I assumed the notice period was only applicable for after.

Anyway, I finished my one month notice period in my previous job and joined the new job. In day one, I absolutely hated the coworkers, the work environment, and even the boss's attitude which had changed a lot from the interview. The coworkers were gossipy and cliquey, and there was no training or guidance provided. Then the boss told me that I might have to stay until 7-8 pm in future, even though the offer letter gives 6 pm departure time.

I really hated it, and thought I should quit asap before I get too involved with them. Please note that there was no official onboarding process yet. I haven't signed anything else, and wasn't given any documents or employee ID. I only worked on preparing a single lecture sheet.

I went home and took some time to think, and sent them a formal and polite resignation email after an hour, effective immediately. Since it was a probation period, I thought the notice period wasn't needed.

Next morning, they responded that they aren't accepting my resignation. That the offer letter binds me to serve them for two years. They also said that they had to wait one month for me, which caused them significant financial damages. And they will pursue legal action if I don't return tomorrow.

Needless to say, I'm very worried. If they really sue me, how much is the possibility of them winning? And how much might I have to pay? My salary was supposed to be 15k.

Also, my previous job (at a school) has contacted me to return if I wished, and I definitely want to go back there.

TLDR: Employer threatening legal action because I resigned without notice period during probation, because I signed an offer letter. How much is the realistic possibility of them winning?

Family & Matrimonial What are some things to look for before marrying a divorce girl? I’m never married man.

I'm 24.She's 28 and divorced. We met 5 months ago doing our respective PhD and MBA programs. We moved things fast—became intimate within the first week, called each other soulmates, everything felt right. I genuinely fell for her hard.

At the 4 month mark, I brought up marriage because I was serious about our future. I asked about her past relationships. She ignored my questions and avoided the topic completely. I got a weird feeling something was off.

I talked to our mutual friend and that's when I found out she was actually divorced. I went back to her and asked directly. She denied it. She said "I'm not divorced. Who told you that?" She got defensive and angry that I asked her friend instead of asking her directly.

Our mutual friend then sent me wedding photos from her actual marriage. I went back to her with those photos in hand and asked what was going on. Only then did she finally admit she was divorced.

She was married for 1 month after dating for 2 years. Her ex-husband cheated on her and left her for another girl. They separated in January 2023 and the divorce is finalized. She still won't share his name or details—just says it's in the past and not worth discussing.

She was scared to tell me about the divorce because of her past trauma. I get that now. But I still need to verify everything is above board before we take this step.

We're ready to move forward. I just need to know what legal due diligence I should do as someone marrying a divorced person in India for the first time. What documents should I ask to see? How do I verify her divorce is actually final? Are there any legal risks I should be aware of?

I want to marry her. I just want to make sure we do this the right way legally.
I have still not told my parents about it soon going to tell them.

Constitutional & News To all the Lawyers...

As per my limited and very little knowledge, according to the first principle, no one should be made a judge in their own cause. The foundational principle makes sense, so the judgment won't be self serving for the judge. So, when we elect MLAs and MPs who are the Legislative authority, and ultimately the lawmakers for this country, how come they make the election laws as well? Ultimately, even if we argue that the laws are not only passed by the ruling government so they cannot really be self serving, but still they are passed by the assent of the very politicians who are directly effected by the said laws. Is there something I am missing or is their a hypocrisy?

Unaware of the Law Father passed 10 years ago. Will my grandma get share too?

I (27f) lost my father to kidney failure in 2016. Mother and I suffered his loss terribly after months of care for him. It was unbearable.

We were disrespected in the worst way possible by everyone (dad's brothers, sisters, his mom, literally everyone) at my father's hometown after his passing. We never really went back there. Ever since my parents got married we stayed in bangalore far away from dad's hometown. He was the only educated one with BE Civil so he had to work here. Rest of them were farmers or lived off their lands through loans.

My father was supposed to get about 33 acres of ancestral land it seems. Which he never got. And after his passing they refused to give it to me and my mother too.

Here through his hard earned money, my dad bought a 3bhk home when i was in 2nd grade. Eventually he got a site too. And made lot of savings and investments over time. He was always open about how all this was for mine and mom's future. My education. My marriage. For his retired life. Unfortunately he passed soon. But for everything, he had made my mother as the nominee. So after his passing, we got it all under my mother's name.

But my mother has had this constant fear since 10 years that one day dad's side family might put a case on us asking for a share in the house, site, and savings. They refuse to give us our rightful share of ancestral land, but same time, they want a share of all our belongings now. Every time we have had a mediator to communicate with them behalf of us and they've demanded the same. They want a share of whatever my father made for me and mom.

This has shattered my mom tbh. She lives in constant fear everyday. She doesnt talking about anything else but this. It has done a number on her. I am deeply scared for her.

Though we are told that father's siblings have no right to his earnings, his mother can claim a share. And my grandma has not been kind to us ever. She lives comfortably with his siblings and being taken care of everyday. Yet she wants to see us miserable.

My father has a brother who also passed away 3 years ago. He has two wives and three daughters. Yet my grandma never tortures them for her share in their belongings. She is torturous only with us. I see and feel no love from her.

Idk how to proceed with all this. I am scared and I dont find any of this fair. I dont see why she should get a share. But idk how all this works. Can someone pls tell if there are cases like this or are we just worrying too much for nothing?

Academia & Career Need Help. Lawyers and law students of Reddit - could you spare 5 minutes to help build something useful for the legal community?

Hi everyone!

I'm building OpenNyaya, a free legal research tool that aims to make finding relevant legal information as simple as searching on Google but grounded and traceable on actual judgements.

But before building further, I need to understand how lawyers actually think and search when faced with a legal matter. And that's where I need your help.

I've created a short survey with 10 real-world legal scenarios. For each scenario/matter/situation, you'll see a suggested search query. All you need to do is select Yes or No depending on whether that's how you'd approach the search.

✅ Takes just 4–5 minutes
✅ No legal expertise beyond your own experience required
✅ No lengthy written answers

I'm not selling anything. I'm just trying to build something that I feel will be genuinely useful, and your input could directly shape how OpenNyaya works.

If you're willing to help, just comment "Interested" and I'll DM you the survey link.

Here is a link for the survey: https://opennyaya.vercel.app/

Even a handful of responses would mean a lot. Thank you! 🙏

Criminal & Police The Case of Psycho Thief and college that blaming things on students

Idk if this case is relevant with this sub, but pls try to help with suggestions.

Part 1:- Thamil Selvan, a psycho thief, has made thefts of students' laptops in 15+ colleges across India over the span of two years. There are several news articles which you can find by simply putting his name on Google. He has been caught by the police more than twice by now, but just 2 days ago he stole 3 laptops from my college NITK, Surathkal. It's so concerning to see why he's still roaming freely even after repeated offences.

https://www.reddit.com/r/Btechtards/s/oqF6qmFDL2

https://www.instagram.com/p/Dehru4CTk1Z/?rpxt=eTNxdmpjZGR3ZG55

My friend was one of the victim. I want to get the attention of higher officials so that they take this case seriously and catch him as soon as possible. What should I do?

Part 2 :- The college is putting students forward and is not accepting its security failure. They're saying that it's humanely impossible to scan every person and it's the duty of students to report any suspicious person. They're saying they won't reimburse the market price of the laptops. They're putting the students through different question rounds and making them run here and there.

https://www.reddit.com/r/NITKtards/s/NNdfvMSCar

I want my friend to get maximum reimbursement at the earliest. He obviously cannot afford to hire lawyers. What should he do?

I've done good knowledge about this case, but can't put everything in this post. Ask any query if you have and I'll be grateful for any suggestions.

Academia & Career Private college in Bihar is asking ₹5000 to return original documents. What should I do?

My brother applied for B.Tech mechanical and passed the entrance exam of this tier 3 private college in Bihar. During the initial admission process, the college took original TC and migration.

They told hostel accommodation would be available. The fees were around ₹3.08 lakh without hostel and ₹4.04 lakh with hostel. They even got my brother to sign a hostel allotment related form, but later told that there's no vacant room in the hostel.

When we asked them to reduce the amount since he wasn't getting hostel, they refused and said it was their rule and we had to pay the full hostel amount (96k).

This made us to cancel his admission process, so we didn't proceed with the education loan or admission. we didn't pay any admission fees neither report to the college.

Now, when he's asking for his original documents back, the principal has been rude and pressured my brother to take admission. Later, a clerk verbally asked him to pay ₹5,000 to get his documents back, then reduced it to ₹3,000 like it was bargaining. They haven't shown us any written rule or explanation for this charge. When I called them to return the documents they just hint to come and meet but never mentioned about this charge on phone call.

Is it legal for them to withhold my brother's original documents in this situation? What should I do if they refuse to return them without payment? Should I complain to UGC, AICTE?

Would appreciate advice from anyone familiar with Indian education law or who's faced something similar.

Consumer Dispute Llyod law college associated pg Withholding refund

Hey everyone, I wanted to share my recent experience with a PG associated/tied-up with Lloyd Law College regarding a refund scam/runaround, and hopefully get some advice on how to handle this.

What Happened

I recently joined Lloyd Law College, but due to the environment not being to my liking and some personal reasons, I had to leave.

I stayed at a PG that has an official tie-up with the college. Their standard policy states that they keep the money if a person leaves within a week. I left after just 3 days.

When I was checking out, the warden explicitly promised me that I would receive a full refund within 30 days. Trusting their word, I left.

The Runaround & Ghosting

**\ Day 30: When I reached out after 30 days, they acted completely unaware of the situation.*

**\ The Delay: Their "refund team" kept stalling. Up until September 29th, I was strung along and led to believe I was getting my full refund.*

**\ The Suspicion: Around the 72nd day, I realized something was wrong because I still hadn't received my money. I tried calling multiple times, but they ignored my calls and emails went unanswered.*

The Confrontation

I finally managed to reach someone on their main helpline. When I demanded answers, she claimed, "We have incurred a loss, we will not refund you," and tried to intimidate me.

I didn't get intimidated; I got frustrated and started speaking in Hindi. She immediately tried to shut me down, saying I was "misbehaving" and threatening to disconnect the call. I pointed out that speaking Hindi isn't misbehaving, and she eventually backed down on that front.

When she denied that any staff member had promised me a refund, I told her I had proof. She then suggested a 3-way conference call with the employees who made the promise. I told her I wasn't interested in a conference call and offered to send the screenshots directly.

The Current Status

After I sent the screenshots proving the promise was made, she changed her tune. Now she claims that "because you have an NOC (No Objection Certificate), I will reduce a month's notice period and refund the remaining amount."

My Questions / Warning

**\ Has anyone else faced this kind of harassment from PG accommodations tied to Greater Noida colleges?*

**\ Even with the NOC deduction they are trying to pull now, can they legally withhold money when I stayed for only 3 days and was explicitly promised a full refund by their warden and staff managing refunds.*

Any advice on how to legally push back and get my full money back would be appreciated. Stay safe out there!

Criminal & Police NDPS vs. IPC: Why does our law treat a joint as a "national threat" but systemic violence against women as a standard crime?

Post image
85 Upvotes

The legal logic we operate under is completely broken, and it’s time we talk about it.

The "Individual Harm" Myth: Under the Indian Penal Code (IPC), offenses like sexual harassment and violence are largely processed as isolated, individual harms.

The reality?

It’s a systemic, daily threat to every single woman in India. Yet, these offenses fall under standard criminal frameworks that allow for significant judicial discretion, meaning bail is often easily granted and pre-trial detention isn't automatic.

The NDPS Overkill: On the flip side, the Narcotic Drugs and Psychotropic Substances (NDPS) Act frames drug offenses as existential threats to the state. Draconian, practically no-bail statutory bars (like Section 37) should logically be reserved for massive cartels trafficking hard drugs. Instead, they are routinely weaponized to ruin lives over weed and hash- substances that are literally being legalized globally.

Lawmakers have created a legal reality where the state wages a significantly harsher, more uncompromising war against a plant than it does against predators threatening half the country's population.

It’s not just a legal loophole; it’s a terrifying reflection of what the state actually views as a priority.

Thoughts?

[Addendum 1: I have mixed up 2 points here, the main one being resource allocation and the secondary one is about adding leniency to the NDPS acts/laws. Trying to address just the first one for now -

Every hour spent processing minor weed possession is an hour stolen from patrolling vulnerable areas and investigating complex sexual assault cases.

The NDPS Act’s strict bail conditions choke the courts. Clearing low-level drug offenses would free up judges to fast-track sexual violence trials, preventing delayed justice and witness intimidation.]

Academia & Career Need a help for my friend(26F), a junior advocate with nearly 3 years of civil and writ experience in Chennai...

Post image
3 Upvotes

Hai guys I'm posting this on behalf of my friend, 26F advocate who is urgently looking for a job in Chennai.

She has nearly 2 years and 11 months of experience in civil litigation and writ matters. She has good legal knowledge and has gained practical experience working under her senior. She was earning around ₹20,000 per month.

Unfortunately, her senior has recently passed away, and she is now looking for a new opportunity to continue her legal career.

She doesn't own a two-wheeler, so an office near a metro station, railway station, or preferably around the Madras High Court would be really helpful for her.

If any advocates, law firms, or legal professionals know of an opening suitable for her experience, please let me know. She is ready to join immediately and I can share her resume with anyone who has a genuine opportunity.

Any leads, referrals, or guidance would mean a lot. Thank you.

Employment & Labour Need help! Where in India • can I file a complaint/ case against a school that has withheld my salary???

My wife had joined a school in 2023 in Pune, India. They had some shit policy (in my opinion) where they withhold your first month's salary and credit it to you only after you resign. Sounds completely unethical to. If you abscond or are terminated, you don't receive it. Well my wife had to quit in between in 2025 due to her pregnancy complications. Now it's been more than a year they are just not bothered to give the money back. They even lied about her not completing resignation formalities (which she 100% dia) then they said they lost her papers. I mean, seriously WTF!???
Now I'm losing my shit and want to take this matter up legally. Is there anything that can be done? Anyone who can help?
