Moving an IRA to Canada: Section 60(j)
Hi all,
I (35M) have a traditional IRA in the US worth about $230k USD. I used to work in the US and had a 401(k) before I moved to Canada and became a Canadian citizen, and then rolled it over to a traditional IRA.
I don't intend to return to the US to live or work, and so while I don't need this money right now, it would be nice to have all my investments in Canada (especially with the current political climate where laws and treaties are fair game).
Has anybody successfully completed a Section 60(j) transfer who can speak to their experience?
Here's what I've gathered so far:
First, I must take a lump-sum distribution. I'll be hit with 30% withholding + 10% penalty due to my age
Within 60 days of the next calendar year, I must contribute the full gross amount to my RRSP. This will not count against my contribution limits for that year.
I must claim the income and the deduction under 60(j) for that tax year for the full amount.
I can then claim a foreign tax credit as per the formula: (foreign non-business income / worldwide income) x Canadian tax otherwise payable.
Assuming I have enough liquidity to transfer the withheld amount to my RRSP, and high enough income in that tax year to claim most or all of that 40% deduction in my taxes, I can effectively complete this transfer tax-free.
For those who've done this before: am I missing something? Are there any gotchas I should be aware of?
