News Rep. Ritchie Torres Announces Congressional Legislation To Protect Video Game Ownership: ‘If You Pay For It, You Own It’
https://kotaku.com/rep-ritchie-torres-announces-congressional-legislation-to-protect-video-game-ownership-20007463951.0k
u/Realistic-Tiger-2842 1d ago
This should be common sense. How can there be a purchase button when we don't actually own the games.
366
u/Local-Poet3517 1d ago
The big games lawyers tried to argue that you are purchasing the rental/subscription. And that eVeRyOnE kNoWs tHiS!
Fucking toads.
Pretty happy it looks like they wont get their way.

u/FollowingFeisty5321 1d ago
There's plenty of opportunity to derail this bill, and since it would inconvenience Apple, Google, Meta and Amazon you can bet they will unleash their lobbyists shortly. I was surprised they hadn't already, normally when a bill pits their rights against ours there is a flood of hit pieces and contrived studies made up by their lobbyists - I tracked some of it back in June:
/r/apple/comments/1u31sh1/american_innovation_and_online_choice_act/or1rd3h/
Another example is California's BASED act in April: "Minutes after Wiener started introducing the bill on March 18 — and even before he was done speaking about it — the Chamber of Progress had already put out a statement attacking the proposal."
31
u/Educatedrednekk 1d ago
And Valve. Let's not forget who brought Apple's 'you never own it' business model to PC games, which before Steam was built on physical media.
-3
u/CKWOLFACE 1d ago
So even Steam is like those idiots?
29
u/Educatedrednekk 1d ago
I don't think they're idiots. They benefit from owning our games. That's why Xbox and Sony are getting rid of physical media. It's bad for consumers because we have less economic power. But Steam is just one of many companies doing this. Netflix, iTunes, Amazon/Google TV. Every platform based economy. There are no laws about this outside California. Hopefully they change it. Make digital property the same as physical.
2
u/Spazza42 14h ago
Exactly.
How hard would it actually be to just allow is to download game files like GOG and store them as a backup?
It can be done but companies aren’t going to do it of their own accord, they need to be forced to make the moral shift.
Interestingly, if this happens to video games it would act as a precedent for other industries behaving the same way, I’m looking at you Amazon/Apple.
Music is DRM locked when you download it, games and videos can easily be the same.
6
u/HammeredWharf 19h ago
It's not common sense, because he's proposing the right to sell your digital games, which would likely be disastrous for video game sales. Imagine millions buying a new 15h long single-player game and reselling it a week later.
That, or stores would just rename the "buy" button.
To me the whole thing looks like a vote fishing campaign that's not supposed to actually go anywhere beyond empty proposals.
18
u/magistrate101 16h ago
You mean like all the secondhand games stores throughout the world the entire time disc-based consoles were popular? The ones that never caused any economic issues?
7
u/Moderated 14h ago
Friction and risk are the key differences.
Driving to the store to sell a disk takes time and effort that clicking a sell button does not.
There is no risk that the used game will not work 100% the same like there is with used disks, it is exactly the same as a new copy. I still remember my used copy of destroy all humans 3 where the game crashed every time you fired a certain weapon so I was soft locked because it was required to finish the game.
5
u/Jojo-the-sequel 16h ago
The ability to sell the digital games you own would solve most of the problems with digital
1
u/chandler55 10h ago
and destroy the indie game market. games are more like movies where youre paying for the experience rather than ownership
2
u/Ensaru4 9h ago
The indie game market will be fine. Movies used to have both rentals and disc collectors.
1
u/chandler55 9h ago
so we'll just have steam replace the buy button with "indefinite rental"
1
u/Ensaru4 9h ago
Sure, why not? The reason why calling it a “rental” is not ideal is due to a negative connotation to the term, and people would question it and think twice about their purchases if the illusion of ownership is broken.
They can’t use “indefinite” because rental agreements are dated services.
Imagine paying $70 to rent a game? This is why they’ve avoid the term in the first place. It’s also why services use “subscribe” instead of “rent”. “Subscribe” sounds more flattering.

u/Aerographic 16h ago
Define "own". Everyone keeps throwing that word around but it means vastly different things to different people.
You'll never own a digital game the same way you own your 90s video games, that's a given. They hinge on servers being available for you to download the game by their very nature.
So it's even more important to explain what exactly you expect from "digital" ownership.
11
u/procursive 15h ago
You'll never own a digital game the same way you own your 90s video games, that's a given.
You're wrong and in two different ways, actually.
Legally speaking you don't "own" your 90s games. You paid for access to a copy of the software (in the disc) and a license to use it. Digital distribution works the same way (replacing the disk with a download, ofc). The publisher had every right to revoke your license back in the 90s and prevent you from using their software just like they do now, the only thing that actually changed is how hard enforcing that right of theirs is.
You might say "well but no one will come for my disk, regardless of legality physical media allows you to keep playing without repercussions", but that's where you're wrong again. That isn't exclusive to physical media. DRM free digital games exist and they allow you to make copies of the game files (or the installer if it's provided) and store them in whatever media you like. The publishers won't come for those copies either, they're just as "safe" and just as "illegal".
Point is, digital distribution is not your enemy. Your enemy is DRM and games that enforce being online for no reason.
0
u/Aerographic 15h ago
You're explaining things to me I already know.
I said you'll never own a digital game the same way you own a physical game, I didn't say your ownership of game data on a physical disc was absolute. You're arguing against something I never even claimed.
2
u/procursive 9h ago
What do you mean by "the same way"? How is a retail disc any more "yours" than an equally functional disc with game files that you burned yourself?
1
u/Aerographic 8h ago
You explained the nuances of ownership yourself, and now you're asking me?
In the case of digital, your "ownership" of the game is subject to a set of terms and conditions that are infinitely more restrictive than whatever fine print comes with a physical disc, the main difference being that the publisher does not have a legal or contractual requirement to keep providing you with an available download of your game copy in perpetuity.

Do away with the 30,000 word EULA's too. At this point it's common knowledge that pretty much nobody reads through those walls of text, let alone understands what they're agreeing to when they sign away their rights.
192
u/FollowingFeisty5321 1d ago
They all take a lot of words to say the same thing - you have no rights, but they sure do.
58
u/Local-Poet3517 1d ago
The real jokers are the ones who release a new eula what seems like monthly, or every patch.
Like thats gonna hold up.
78
u/WayneZer0 1d ago
funfact because nobody reads them in eu thier not legaly binding. especial if thier extremly long or phrase in no comon speach
55
u/____Manifest____ 1d ago
How did you get all that past auto correct?
47
u/TaxOrnery9501 1d ago
Can't speak for them, but I disabled the autocorrect/suggestive-text on my phone because the feature was replaced by AI and became laughably unusable. It takes me twice as long to type now, but at least I'm typing the words the way I want to them to be typed.
4
u/cgaWolf 13h ago
I am not alone \0/
4
u/TaxOrnery9501 12h ago
It's amazing how many previously-useful features have been bastardized in the name of pushing the AI agenda. Remember using Google as a Dictionary/Thesaurus to look up definitions? It used to give you the words entomology, usage over time, regional varaitions, and a list of synonyms/antonyms. Now it's just an AI-generated synopsis that includes none of that and is wrong 40% of the time.
We really are living through a 2nd burning of the Library of Alexandria, and the best days of the internet sadly seem to be over 😞.

Very likely English isn’t their first language and so their phone is set to another language.
6
u/amazing_asstronaut 1d ago
Either way, they can't legally ask for anything that's outside of the law, so really all legislated consumer protections apply. So even if they say that's in the EULA, well so what. But it does come down to what's actually in the law, ultimately if that gets reformed then they got no dice with EULA.
1
u/magistrate101 16h ago
There should be massive fines for every provision that's unlawful multiplied by every person they got to agree to it.
2
u/Immolation_E 17h ago
Fun fact: In much of the US they're non-binding. But because lawsuits are expensive and we have to cover our own costs, it doesn't matter. Most people fold when the corpos come at them bc they can't afford the lawyers.

One of the actually good uses for AI lmao. Especially if you were just going to blindly hit I accept either way, getting a quick AI skim of it can actually find stuff
Very useful for things like contractors who are giving you quotes for your house repairs etc too. Had several HVAC contracts recently where I was just going to accept after skimming, but ran it through multiple AI and they all caught random things they had sneaked in or said they wouldn't cover etc, that I called the HVAC companies out on
Used car salesman are the actual worst about it too, having ai check the fine print legit actually saved me on multiple shady crap they were trying to pull while I was buying my car

u/PM_ME_SAD_STUFF_PLZ 23h ago
I've read through them and they're really not that bad, and they're all really similar too.
4
u/TaxOrnery9501 21h ago
Overall, the ones for the games themselves aren't great, but some of the hardware EULA's are just pure evil. Like with the Meta Quest 3 or LG TV's, for example, which essentially make you give them permission to wiretap/videotape you, your house, and everyone it comes into contact with (even indirectly), at all times.
0
u/Kaining 18h ago
Which introduce the very funny concept of "you can consent in place of someone else without informing them they're consenting to the striping of their basic human rights", which is kind of the rapiest thing you can say.
So yeah, in EU, they're legaly non binding and you can't just come up with eula that say "i can kill you and you'll have to say thank you". Well, you can, but you'll still end up doing life if you kill someone.
1
u/PM_ME_SAD_STUFF_PLZ 16h ago
Rapey is crazy dude just some fucking perspective
0
u/Kaining 13h ago
You either understand how consent work or you don't. If you don't and act like that everywhere, there's a a high chance you'd be a "good frat boy" in private.
1
u/PM_ME_SAD_STUFF_PLZ 13h ago
Except consent by silence or lack of rejection is a thing in commerce.
1
u/Kaining 13h ago
Remind me, what the core debate about commerce, and thus, capitalism ?
Ah yes, regulation from governments (the people) to keep those psychopath in check and not let them fuck up the planet...aw shit, they won. They raped the planet to death already.
Also, where do the guys that come up with those sort of thing comes from ? IVY league frat house for the most of them ?

Introducing legislation is one thing, actually getting it passed through a committee, the House, the Senate, and then finally getting it signed by the President is an entirely different thing. Not to mention the corporate lobbying done against this type of legislstion, and the many hurdles like the filibuster, etc.
So all in all, it's nice that it's a conversation happening on the national scale, but that's all it is, it's just conversation and dialouge. This isn't going to go anywhere anytime soon unfortunately.
18
u/FlamboyantPirhanna 1d ago
Probably true, but don’t let cynicism rule the conversation. It shows that the movement is growing. It probably won’t pass, especially in the current congress, but it won’t be the last bill of its kind. Don’t stop making noise.
3

u/SSchorik0101 1d ago
Yeah it likely won't succeed because a large number of those people who decide are in the pockets of big corporations and own lots of shares in them. They aren't going to vote in favor of something that loses them money. Shame, really.
3
u/KyleVPirate 1d ago
Yep. Super pacs, dark money, and the oversized influence of billionaires/ a trillionaire in politics is ruining everything. We'll own nothing, and be happy about it. Sigh.
4
u/FollowingFeisty5321 1d ago
It's way more blatant than that when the trillion dollar gang's app marketplaces could be mildly-inconvenienced:
For two years, Google, Apple, Amazon and Meta formed a unified front and spent more than $100 million in lobbying and advertising to kill the American Innovation and Choice Online Act — a bipartisan bill in Congress similar to the Based Act — in 2022.
0
u/KyleVPirate 1d ago
I don't understand your comment? That's corporate lobbying and dark money at work. That's nothing new. You can thank Citizens United, among other factors, for that.
Again, this legislation is going to go nowhere.

Sometimes I don't know what the fuck is going on in new york. You've got Zohran Mamdani, one of few truly "left wing" elected officials in the country, who stomped andrew cuomo in the primary and has so far been extremely popular among his constituents, but the same city also keeps electing useless shitheads like Hakeem Jeffries, Chuck Schumer, and Richie Torres. I assume there's some kind of inter-borough caste system i'm not understanding here between say, brooklyn and staten island.

u/Arawn-Annwn 1d ago
I would like my right of resale to return, but that won't be happening. Digital delivery livery killed it and it ain't coming back. Everyone talking about digital veing licenses has missed the point: we were already being told that when things were still on physical media, it was on a little slip of paper inside the shrink wrap box or in the manual and in the 1st click throigh agreements that nobodybwas reading telling us even back then that we owned a license, but that was to explain we didn't have the right to make copies and to curb reverse engineering efforts that might have threatened copy protection mechanisms or lead to competing lroducts that used their proprietary engine.
But now that language is used to prevent you from even "owning" your specific copy - the thing you payed for. You quietly lost your property rights little by little without realizing it.

u/GodLikeEnergy 1d ago
I support this, don't get me wrong. I find it ridiculous that physical media is different from digital media. It should be treated the same. You buy the disc, it's the same as a digital license, you get the right to use it and give it to other people. Why should digital be exempted, because of data? If they don't like that, then just change the wording. Permanent rental license, some legalize language of course.
He's just saying this to help him get elected. You'll see a lot of them support these policies. Getting off topic, I don't mean to, but In 2020, you'd see them supporting medicare for all, but if you look, nothing. Like Joe Biden, he said he supported a public option. He didn't propose a single public option bill. One could say that was a large factor of many reasons he was elected over over Trump.
I have a feeling, if he wins. He'll just drop it and move on. Come back in 2 years.
2
u/orangeKaiju 1d ago
Note: this is my layman's understanding of US law, and as IANAL I may have parts of this wrong.
Technically when you have it on disc, you only own the physical disc. The license is essentially the same, and you do not own the software.
In the case of physical media, the license technically only applies to the copy of the data on that specific disc. While US copyright law technically allows you to make back up copies of and media you purchase, US DMCA law doesn't allow you to circumvent any protections to do so, so essentially that specific disc is your only legal copy of the media in most cases. If you scratch the disc, ruin the cartridge, etc, you are out that copy.
With digital media, you are not restricted to a specific copy of the data, however your license is really only good via the storefront you purchased it from. Digital licenses are also generally non-transferable.
This isn't just true of games, but all media.
There's pros and cons to both formats within the current legal framework, and modifying the framework would certainly alter those pros and cons, but some of them would remain the same.
If we were to rework the framework, ideally we would still purchase licenses to the media, however the license itself would be independent of any physical copies or digital storefronts and be able to be traded/transferred/resold etc
This way if your disc gets scratched, or you spill coffee on your book, you can easily replace the physical copy with a digital.
The problem with that is accountability, where do the licenses get maintained? Is there a central registry? Do we use a block chain model? Also, how do we handle different versions? If you purchased a movie on a disc in 4k, if an 8k remaster is released later, does your license allow for you to have access to the 8k version, or does that version have its own license that needs to be purchased separately? If not, who is going to maintain the digital repository for each version?
If we stick solely with physical media, it's on you to maintain hardware that can continue to access that physical media, in addition to maintaining the media itself.
That can be more complicated than just keeping the disc forever.
The first games I ever bought were on a cartridge for a system that is no longer manufactured. If I still had a working system, it doesn't have cables for modern displays, so I'd need to buy a specialized piece of hardware just to connect it to a modern display, or i'd have to also find or have kept and maintained an older display to ensure I can continue to access the media. Plus all this takes up space, the more stuff you have, the more space it takes up.
In reality, even with ownership, nothing is forever, because everything breaks at some point, and we don't always have the skills, knowledge, or parts to repair things. A transferable license has benefits over physical media in this regard.
Even with a better legal framework, it's not really a simple question as to which form of media is better, and what ownership actually means.

2
1
u/GodLikeEnergy 7h ago
public option is where you can opt into medicare or medicaid regardless of ability to pay or employer as far as I understand. It's more of a form of competition to private sector.
ACA, has high premiums. If you can't afford medical insurance like no job. It will help you get medicaid or whatever. If you can afford it, a bit it'll help supplement it but it'll be a private plan. It'd also help pool in more. The rest would be through employer.

As much as I like it, let's be honest.... "If you buy it, you own it" will be really hard to legislate.
How do you own a completely online game? It would be difficult for congress to invalidate your copyright just because you're not developing, supporting or keeping the back end up. They can't force me to release it into the public domain. There would be a strong takings clause argument to make
1
u/ResistLongjumping999 12h ago
the article talks about it but Torres is definitely a gamer and was most likely personally pissed off by the news that NBA 2k25 is being shut down this year lol. I agree the actual language of this bill will need to be painstakingly crafted to actually be effective and that's if it even gets put to a vote and passes, overall very slim to none chance of this happening. But you don't win if you don't fight so i'm with him on this.
1
u/vyvexthorne 1d ago
No matter what, that's a hard fight. It' would mean changing all digital rights... which includes music rights. And those music rights folks really, really, really don't want you owning the music. They don't even let video games or tv shows own the music.

Can they also stop video game censorship while they are at it?

u/wyattlikesturtles 1d ago
Like what?

u/Marius-J 21h ago
like how when certain 'groups' of people don't like the fact that there is for example violence, sex, sexy outfits or the like in a game, and then they'll strongarm payment providers into forcing game providers like Steam to remove it from their stores.

u/Altair05 16h ago
Are you talking about the credit card companies trying to get porn games banned? Didn't they back off of that?
1
u/wyattlikesturtles 14h ago
Yes but when has this happened recently? I thought things were going pretty well on this front but I may have missed something

Like I said in r/pcmasterrace, it still doesn't make up for the fact that he is bought and paid for by isreal and is absolutely a scum politician.

Its always been clear that you don’t own your digital content
I am not shilling for these horrible companies. They openly lied about it, and should pay every fee, cost, and loss associated with that lie. But anyone paying attention has been screaming from the mountaintop since 2013 or so, digital ownership isn’t a thing. At its best it is merely access to a file you cannot own.

I'm pretty sure this guy is generally a PoS, but if the title of this post is accurate, that'd be good legislation regardless

How's he a PoS?

Because redditors only cares about Israel. It’s the only issue in the world that matters and is the binary arbiter of morality.

He is an opportunist snake who loves to take foreign money, but I 100% agree with him on this specific thing.

So when you said foreign money you weren’t talking about AIPAC?
Torres support for Israel is all you know about him. This isn’t a gotcha

Microsoft has been caught rescinding ownership rights for certain games that later made their way to GamePass -- if you owned Hitman World of Assasination, you know already what I mean.
Some moron got the coding mixed up, and accidentally wrote the GamePass subscription checking algorithm so that when a game was removed from GamePass or your membership was not renewed, the rights/license to the game was removed from your account BEFORE it checked to verify whether you already owned it.
It was a largescale crime which they were never held accountable for. They stole $65 from millions of people on that one single game alone.

u/wisesager 21h ago
Did players ever get their licenses restored?
1
u/Bikelangello 21h ago
Well, the one time I actually got to talk to a person, they wanted me to verify which prepaid thrown away debit card I ordered it with!
Didn't have it, or know its number.
So they couldn't help make right what they messed up!

u/Bikelangello 21h ago
Most frustrating part was, the guy said he could see on his end that I owned it. But my Xbox would not recognize that I owned it. And I was online.

I wish there was an ultra warning before it's too late and I've given fucking Kotaku of all things a click. God damn I wish I could take that click back.

I have an extremely simple solution. Create a company, where you must pay 400 trillion dollars to use their logo. Said company refuses to charge, until you fail to uphold your promise, which is that your game must be able to play offline.
Only buy games, who have agreed to the terms of using said logo. If you continue the terms, you never pay. If you want to be greedy, and take your game offline (along with all the loot you made) then enjoy paying back 400 trillion. As-is, i will not buy anything from a AAA company as its only fueling anti-consumer policies.

You get what you agreed to. If you don't like the idea of buying a "digital ownership contract", then don't buy it.

It's a good start but needs to extend to all digital media.
