Thoughts from the gun store
So I work for a small gun store in the middle of nowhere panhandle. Im sure everyone and their brother has their opinions and questions about the latest and greatest AFT announcement, and Im hoping I can shed some light in our great state based on our interpretations, inferences, and legal consultations to give a rough idea of expectations as things go forward.
The store I work for did not process NFA items prior to the open letter for context. We are not currently doing so but probably will shortly since we did not have any inventory on hand.
Suppressors:
- Everything we're seeing says it should be gtg in Florida and is to be treated like a handgun with regards to state lines, purchasing requirements, etc.
- We will not be processing any used suppressors, as we cannot trust that they will have been properly removed from the NFA registry and we would like to keep our license.
- Once we have inventory, sales will likely not begin until after mid terms. If congress flips, this will likely turn into an additional fustercluck. That feels like the only immediately obvious point where it may turn into a resumption of enforcement without amnesty.
- Any new suppressors will have to come in without a Form 3, as if a suppressor is Form 3ed to us the law and letter read like it ought to have an accompanying Form 4 to leave the books. Easiest way to ensure that will be receiving from a distributor without a Form 3, so it is unknown if we will do transfers or only sales once we do begin doing 4473s.
SBS and SBR:
- State law prohibits in a stupidly vague way, that theyre only allowed if they meet provisions of federal law. Electing to not enforce is not the same as striking a law, so that will need clarification from the state AG.
- Many LEOs we know are considering 790.221(3) to be satisfied and 790.221 as a whole to be obsolete or moot without the AGs clarification. Cant guarentee that itll stay that way but until its clarified I would recommend either CYA with a Form 4 or learn to STFU instead of posting for internet cool points. Youre probably fine though cause they wont arrest half of the deputies and what who out there over this.
- FFLs have an additional requirement for SBR and SBS transfers under federal law to receive federal AG approval. The ATF is electing not to enforce this additional requirement that the Form 4 used to satisfy.
- Given that there is no established process to receive the federal AGs approval now beyond a Form 4, we're electing not to handle SBRs or SBSs until theres a clarified process or this additional requirement is struck.
Hope this is helpful to some degree, its all clear as mud
